1What Capitol Gains is

Capitol Gains (“we,” “us,” the “Service”) is a data analytics platform that performs statistical calculations on public government filings, specifically congressional stock trade disclosures made under the STOCK Act. We publish the results of those calculations, including but not limited to Interest Points, Luck Scores, and Conviction Scores.

Capitol Gains is not a registered investment adviser, broker-dealer, financial planner, or fiduciary under any federal or state securities law. Nothing in the Service constitutes investment advice, a recommendation, or a solicitation to buy or sell any security.

2Data sources and accuracy

Our underlying data comes from public congressional disclosure filings (House Clerk and Senate Electronic Financial Disclosure systems), SEC EDGAR, and third-party market data providers. We do our best to ensure accuracy, but disclosure filings themselves can contain errors, delays, or ambiguous amount ranges — a structural limitation of the source data, not something we control.

All metrics on this Service are mathematical outputs derived from that data. Past performance does not guarantee future results. We make no warranty as to the completeness, timeliness, or accuracy of any data or calculation displayed.

3Not investment advice

Every number on this Service — Interest Points, Market Luck, Capitol Luck, Conflict-Convergence Score, equity curve, win rate, or any other metric — is a formula output describing what has already happened in public data. None of it is a prediction, recommendation, or instruction. We never tell you to buy, sell, or hold any security. We never suggest that any trading strategy will be profitable.

What you do with the information on this Service is entirely your own decision and your own responsibility. If you are considering any investment decision, we recommend consulting a licensed financial adviser.

4Subscription tiers

The Service offers a free tier and paid subscription tiers (Pro, Connect, and API) described at /pricing. Paid tiers are billed on a recurring basis until cancelled. You may cancel at any time; access continues through the end of the billing period already paid for.

We reserve the right to change tier pricing or feature composition with notice to active subscribers.

5Connect tier — webhook data events

The Connect tier lets you configure thresholds (e.g., Interest Points above a value, a specific politician, a specific sector) and receive a structured JSON data event at an endpoint URL you provide when a public filing matches those thresholds.

We emit data. We do not know, control, or monitor what systems receive these events or what actions, if any, those systems take. We do not integrate directly with any brokerage or trading platform. We do not execute trades, route orders, or take custody of funds. The payload we send contains data — scores, filing details, timestamps — not instructions.

You are solely responsible for configuring, securing, and acting on your webhook endpoint, and for any consequences of automations you build on top of the data we provide.

6API tier

The API tier provides programmatic access to our published scoring data for your own applications. Standard rate limits apply per your subscription level. You may not resell raw API access as a competing data product without a separate commercial agreement.

7Acceptable use

You agree not to:

  • Scrape or bulk-extract data from the Service outside your subscription's intended use
  • Misrepresent our published metrics as investment advice to third parties
  • Use the Service to harass, defame, or make false factual claims about any individual
  • Attempt to circumvent rate limits, authentication, or subscription tier restrictions

8Disclaimers and limitation of liability

The Service is provided “as is” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any calculation will be accurate or complete at all times.

To the maximum extent permitted by law, Capitol Gains and its operators are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to any investment decision made in reliance on data published here.

9Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date above. Continued use of the Service after changes constitutes acceptance.
